Changes to the Federal Rules of Bankruptcy, Appellate, and Civil Procedure, and Forms Effective December 1, 2025
On December 1, 2025, amendments made to the following Federal Rules of Bankruptcy, Appellate, and Civil Procedure, and Forms will take effect:
- Federal Rule of Bankruptcy Procedure 3002.1 Mortgage claim status during a chapter 13 case. Verifying/objecting to post-petition default requires the use of new forms listed below
- Federal Rule of Bankruptcy Procedure 8006 Revised to clarify that any party may request a direct appeal to the Court of Appeals
- Federal Rules of Appellate Procedure 6 and 39
- Federal Rules of Civil Procedure 16(b) and 26(f)(3)(D): Discovery plan requirements
- Official Form 410C13-M1: Motion to Determine the Status of the Mortgage Claim
- Official Form 410C13-M1R: Response to Official Form 410C13-M1
- Official Form 410C13-N: Notice of Payments Made (Trustee)
- Official Form 410C13-NR: Response to Official Form 410C13-N
- Official Form 410C13-M2: Motion to Determine Final Cure/Payment of Mortgage Claim
- Official Form 410C13-M2R: Response to Official Form 410C13-M2
- Official Form 410S1: Notice of Mortgage Payment Change
- Director’s Form 2000: Required Lists, Schedules, Statements, and Fees
- Director’s Form 2030: Disclosure of Compensation of Attorney for Debtor
- Director’s Form 4100C: Order Determining whether Defaults have been Cured and post-petition Amounts Paid
