Obtaining Transcripts (8/21/07)

Hearings Before Judges Using Electronic Court Recording (ECR):
1. Contact one of the court approved transcription services. You will be advised as to procedures and costs pertaining to your request. Note that the court makes no recommendation as to which service to choose.

2. The service will contact the court to obtain a digital audio recording of the hearing you have requested. Using the recording, the service will produce and provide you with a hard-copy transcript of the hearing.

Please do NOT contact the court for transcripts, other than for those of pre-ECR hearings (see below).

Pre-ECR Hearings:
Transcripts of hearings held prior to implementation of ECR may be obtained by contacting the appropriate Court Reporter's office. Check at the intake counter of the Clerk's Office for advice as to which Court Reporter to contact.

Reproduction of Recordings of Proceedings (ECR Cases):
For a fee of $34.00, you may obtain a copy of the recording of a proceeding on CD or, in certain Central Islip cases, audio cassette. Complete the Reproduction Request Form and return it to the court along with your payment.

Maximum Transcript Rates - All Parties, Per Page
At its September 2022 session, the Judicial Conference approved an increase of ten percent to the maximum original and copy transcript fee rates, and at its 2023 session, the Judicial Conference approved modifying transcript category names to ensure clarity regarding delivery timing. The following rates are now in effect.

  • 30-Day Ordinary Transcript is a transcript to be delivered within thirty (30) calendar days after receipt of an order
  • 14-Day Transcript is a transcript to be delivered within fourteen (14) calendar days after receipt of an order
  • 7-Day Transcript (Expedited) is a transcript to be delivered within seven (7) calendar days after receipt of an order
  • 3-Day Transcript is a transcript to be delivered within three (3) calendar days after receipt of an order
  • Next-Day Transcript (Daily) is a transcript to be delivered following adjournment and prior to the normal opening hour of the court on the following morning, whether or not it actually is a court day
  • 2-Hour Transcript (Hourly) is a transcript of proceedings ordered under unusual circumstances, to be delivered within two (2) hours

Privacy Protection and Redaction Requirements

Pursuant to Federal Rule of Bankruptcy Procedure 9037(a), unless the court orders otherwise, documents filed with the court may include only :

  • the last four digits of a Social Security number and taxpayer identification number;
  • the year of an individual’s birth;
  • a minor’s initials (for individual, other than the debtor, known to be and identified as a Minor); and
  • the last four digits of a financial account number.

When a transcript is filed, the attorneys and pro se parties who attended the hearing are solely responsible for redaction of the information described in the Rule. Redaction is accomplished only with input from the attorneys and pro se parties who attended the hearing. Transcribers are not responsible for identifying a need for redaction or for redacting transcripts absent a request by an attorney or pro se party.

The court’s responsibility is to follow the Judicial Conference guidelines for providing public access to the transcript and for restricting access in accordance with the Judiciary’s privacy policy.

The clerk is not required to review documents filed with the court for compliance with this rule.

The responsibility to redact filings rests with counsel and the party or non-party making the filing.
